Proposal by Shiv Sena MLA Rupesh Mhatre to amend the Bill

Mumbai: No establishment should be named after any Deity or any religion so that religious sentiments will not be hurt of followers of any religion. The above amendment should be carried out in the Bill. The said point was presented by Shiv Sena MLA Rupesh Mhatre during discussions on non-governmental issues. (Congratulations to Shiv Sena MLA Rupesh Mhatre for presenting the proposal of imposition of ban on using any Deity’s or religion’s name for any establishment or shop ! – Editor SP) Discussion will be held on this proposal during the session. He has made a demand that the above clause should be added to the Shops and Establishments Act, 1948, Bill No. 30, clause 7, sub-clause (1) and part C .

The purpose of addition of this clause and reasons are said to be that ‘according to the present provisions of the said Act, there is no condition stipulated on the nature of names to be given to any establishment, shop, commercial institution, hotel, eatery, film theatre or entertainment centres. Nowadays, therefore, it has been observed that most of the eateries, theatres or especially bars opened under the guise of entertainment bear the names of Hindu Deities e.g. ‘Sai Bar and Restaurant’, ‘Hanuman Bar and Restaurant’ etc. The establishments, hotels and entertainment centres opened mainly for enjoyment of people have Deities’ names leading to hurting religious sentiments of Hindus. This can also create discontent among people. Many voluntary pro-Hindu organizations and alert citizens are making demands with the Government to request the owners of such establishments for changing their names. In this background, the above provision may be made in the law so that sentiments would not be hurt of followers of any religion and there would be no communal disharmony. The amendment will also impose restrictions and provision should be made to punish the owner of establishment who acts against the above amendment. This demand has been made with the Government.
