Panaji (Goa): ‘Communal violence prevention, control and rehabilitation of victim’s Bill 2011’ is being prepared with malicious intention by persons having perverse mind. There is intention of controlling religion based riots at all. The Bill is full of mistakes. It will not stand the test of the court. It is impossible to transform it into a law. Despite this, the Congress Government is trying to mislead he minorities for its own political gain, said Adv. Saresh Lotlikar. He was addressing the gathering attending the seminar on ‘Communal violence prevention, control and rehabilitation of victim’s Bill 2011’, organised by Hindu Janajagruti Samiti, at Manoshanti Hotel, Panaji, yesterday evening. Adv. Ramdas Kesarkar, legal advisor of Sanatan Sanstha, Adv. Mr. Pravin Phaldesai and Mr. Jayesh Thali, coordinator of ‘Gomantak Mandir and Dharmik Sanstha Mahasangh’ were on the dais. Advocates, editors and other respectable citizens were present for the seminar.

The Seminar began with lighting the auspicious lamp at the hands of Adv. Saresh Lotlikar. While giving more information regarding the proposed ‘Communal Violence Bill’, Mr. Lotlikar said that 80 % of Hindus have been targeted in this Bill. According to the provisions in the Bill, a person can be exiled before the crime is committed. This bill is an attempt on the part of Congress leaders to deviate public attention from the millions of rupees scams. As far as the present law is concerned same law is applicable to the criminal involved is a rape case, irrespective of the religion of the raped victim. But in this proposed Bill the punishment given in case of a Hindu victim of rape differs from that given in case of a minority victim. A raped victim from a minority is entitled for 5 lacs of rupees as compensation according to this Bill, and the funniest part in it is that the compensation is not to be paid by the criminal involved in the rape as prevalent but the Government has to pay it. ‘Enjoy and earn money’ might be the repercussion in this case. This Bill might invite crimes. Generally a retired Judge is appointed as a chairman of any Commission; but in this Bill there is no such condition laid in the ‘Peace Commission’ (Salokha Aayog) that a retired judge has to be appointed as a chairman of that commission. It is only said in the proposed Bill that the chairman should be of a good moral character. The peculiar thing is that the chairman of the said Commission can be selected by the Prime Minister and the Chief Minister; but the question is, when these persons themselves have doubtful characters, how can they select the abovementioned chairman? The proposed Bill is not fulfilling the conditions laid down by the Constitution of Bharat, in fact it is opposing the Constitution. Adv. Pravin Phaldesai informed the audience that although the Hindus in Jammu and Kashmir are being tortured invariably, the said Bill will not be applicable to Jammu and Kashmir. Adv. Ramdas Kesarkar said that this Bill will be depriving Hindus of their fundamental rights. Therefore it is the duty of each Hindu to oppose this Bill. Mr. Jayesh Thali explained the role played by Hindu Jajagruti Samiti (HJS) in opposing the ‘Communal Violence Bill 2011’. Compering was done by Mr. Govind Chodankar.
