Anti-Hindu speeches at NEET protest: HJS and SC Lawyers demand FIR against Kunal Kamra and Prakash Raj

Joint delegation of HJS and Supreme Court lawyers submits memorandum against hate speeches 

New Delhi – Shocking incidents of open insults to the Hindu religion and anti-national provocations have come to light during the ongoing students’ protest over the NEET exam issue, spearheaded by the ‘Cockroach Janata Party’ (CJP) and Sonam Wangchuk at Jantar Mantar. 

In response to these events, a joint delegation comprising Supreme Court lawyers and the Hindu Janajagruti Samiti (HJS) filed a formal written complaint today at the Parliament Street Police Station in New Delhi, demanding stringent legal action against the offenders. 

Memorandum submitted to the SHO of Parliament Street Police Station 

The memorandum was handed over in person to the Station House Officer (SHO) of the Parliament Street Police Station. The delegation included Supreme Court Advocates Makarand Adkar, Amita Sachdeva, Atul Sharma, Mayank Dwivedi, Keshri Satya, Parth Yadav, and Yadavendra Saxena, along with HJS Delhi State Coordinator Kartik Salunke and Shriram Luktuke. 

Derogatory remarks on Prabhu Shri Ram and the Hindu faith

According to the official complaint, stand-up comedian Kunal Kamra made a highly derogatory statement from the protest stage, remarking, “For years, this government has been taking the name of Sita’s husband (Shri Ram) but doing the work of Nita’s husband (Mukesh Ambani).” The delegation stated that this deeply offensive remark has hurt the religious sentiments of 100 crore Hindus.

Additionally, the complaint highlighted that a woman on stage sang a provocative song by Pakistani poet Faiz Ahmed Faiz, emphasizing the lyrics, “Sab but uthwaye jayenge… bas naam rahega Allah ka” (All idols will be removed, and only the name of Allah will remain). The delegation termed this a direct attack on idol-worshipping Hindu Dharma.

Instigating speeches and links to radical outfits

The complaint further raised serious concerns regarding the presence of Syed Qasim Rasool Ilyas, father of Delhi riots accused Umar Khalid and an individual associated with the banned radical outfit ‘SIMI’ (Students Islamic Movement of India), on the same stage. Furthermore, actor Prakash Raj is accused of using the platform to instigate the youth to rebel against the system, provocatively stating, “We do not care if we are called terrorists or Pakistanis.”

The delegation asserted that these incidents clearly expose that the gathering is no longer a students’ movement, but a political agenda driven by anti-national and left-wing elements. Citing the historic Supreme Court judgment on ‘Hate Speech’ (Shaheen Abdulla vs. Union of India), the memorandum strongly demands that the police initiate immediate suo motu action without awaiting further directives.

Demand for immediate FIR and UAPA probe

The joint delegation has demanded the immediate registration of a First Information Report (FIR) under the Bharatiya Nyaya Sanhita (BNS), 2023. Specifically, they invoked Section 299 (hurting religious sentiments), Section 196 (promoting enmity between groups), Section 152 (endangering the sovereignty and integrity of India), and Section 353 (making provocative statements).

Furthermore, copies of the complaint have been forwarded to the Union Home Minister and the Delhi Police Commissioner. The delegation is demanding a comprehensive investigation under the Unlawful Activities (Prevention) Act (UAPA) to probe the funding of this protest and the active involvement of individuals linked to SIMI. 

Individual legal action prior to joint memorandum

Ahead of the joint delegation’s complaint, separate legal measures were set in motion following the viral spread of the Jantar Mantar video clip on social media. 

Supreme Court Advocate Amita Sachdeva served a formal legal notice directly to Kunal Kamra, demanding an unconditional public apology, the immediate deletion of the offending clip from all digital platforms within 48 hours, and a written undertaking to cease outraging Hindu feelings. 

Simultaneously, Advocate Pradeep Naik filed a formal complaint with the Cyber Police Station under the Pimpri-Chinchwad Police Commissionerate in Pune.
