Andhra court recalls bailable warrant issued against MS Dhoni

Anantpur (Andhra Pradesh) – A local court on Wednesday recalled a bailable warrant it had issued last month against cricketer Mahendra Singh Dhoni in connection with a complaint which accuses him, incredibly, of ‘hurting the religious sentiments of Hindus.’

Dhoni’s lawyers Pankaj Bhagla and M. Vishnuvardhan Reddy today filed a “vakalatnama” before the sessions court judge Y. Vijayakumar who accepted it and withdrew the warrant before posting the matter for final hearing to July 25. The lawyers told the court that Dhoni came to know about the warrant against him only through the media.

The complaint in this regard had been filed in June last year by Gopal Rao and Shyam Sunder who reportedly belonged to a right wing Hindu organisation. The duo had said Dhoni was shown in the form of a Hindu deity on the cover page of a business magazine, holding among other things a shoe in his hand, which they said was “hurting the religious sentiments.”

They also wanted registration of an offence against the then editor of the magazine. In his counter affidavit filed before the court today, the then editor said the complaint, filed under section 295 (injuring or defiling place of worship with intent to insult the religion of any class) of IPC, was not maintainable and there are no grounds to restore the plaint.

“The publication neither destroyed, damaged or defiled any place of worship or any object. The complainant has also failed to establish the intention to insult any religion or the knowledge of the same on the part of the accused.

“The magazine page has to be seen in consonance with the article published inside the magazine, which does not mention about any God directly or remotely not has it made any attempt to portray Dhoni as Lord Vishnu…It is purely a work of art,” he said in the affidavit filed through his advocate V Yagna Dutt. The affidavit will also be heard next week.

Andhra court issues arrest warrant against Dhoni : Issue of denigration of Vishnu

Bhagyanagar (Hyderabad) – A court in Andhra Pradesh issued an arrest warrant against Indian cricket team captain M.S. Dhoni for allegedly hurting the religious sentiments of Hindus.

A local court in Anantapur issued the arrest warrant as Dhoni did not appear in the court despite three summons served in the past. It directed police to present Dhoni in the court July 16.

Business Today in its April 2013 edition had carried the picture. Dhoni was portrayed as Hindu god Vishnu with a sub title “God of Big Deals” and holding products of several companies including a shoe in his hand.

Y. Shyam Sunder, a local Vishwa Hindu Parishad (VHP) leader, had filed a petition in the court in February this year alleging that the cricketer had hurt the sentiments of Hindus by denigrating the Hindu god.

The summons issued by the court to Dhoni on three occasions was returned. The court, which took up the hearing on Tuesday, issued the arrest warrant.

The Delhi Police on Saturday told a court in Delhi that the photo of cricketer Mahendra Singh Dhoni in a magazine posing as Lord Vishnu and holding a shoe in his hand “is a work of art” and the player had “no intention” to insult the Hindu religion.

Police had filed their status report in pursuance to the court’s order on a complaint seeking registration of an FIR against Dhoni, publisher and editor of a magazine for allegedly insulting Hindu religion and its gods and goddesses.

“In this regard, it is submitted that the photograph of Mahendra Singh Dhoni published in the said magazine may not be a deliberate or intentional act of him.”

“The photograph of Dhoni published in the magazine is a work of art and animation done by the artist/publisher of the said magazine,” the report filed by officials of Nand Nagri Police Station said.

The report was filed before Metropolitan Magistrate Mayuri Singh who fixed the matter for September 9 for hearing arguments on the registration of FIR.

“It is also to be mentioned here that no other such complaint apart from this present complaint has been received at Police Station Nand Nagri in this regard,” the report said.

The court was hearing a complaint filed by Rajinder Singh Raja, national general secretary of a social organisation Shivsena Hindustan, alleging that in the April 2013 edition of the magazine, Dhoni was portrayed as Lord Vishnu with a sub-title ‘God of Big Deals’ and holding products of several firms including a shoe in his hand.

The magistrate had earlier issued bailable warrant of Rs 5,000 against a sub inspector for his failure to comply with the court’s earlier order directing him to file a status report in the complaint.

In his complaint, Hiremath alleged that by posing for an advertisement in a business magazine as Lord Vishnu holding several things including a shoe in his hands, Dhoni had denigrated the Hindu god and hurt religious feelings of the Hindus.

Taking cognisance of the offence and registering the case, the court posted it to May 12 for recording of the statement of the complainant.
