Historical decision of Mumbai High Court !

Mumbai : Mumbai High Court has withdrawn ban on women’s entry in Haji Ali durgah at Worli through an order passed on 26th August 2016.

Justice Vidyasagar Kanade and Justice Revati Mohite-Dere explained while taking such historical decision on entry in Haji Ali durgah that wherever men are allowed to go, women should also have right to go; therefore, there will be no discrimination now between men and women for going to Haji Ali durgah.

Trustees of Haji Ali durgah have sought time for challenging this verdict in Supreme Court. The Court has agreed for the same and given interim stay of 6 weeks on this order. Haji Ali Trust has said that the High Court has passed such verdict under pressure whereas MIM’s Haji Rafat has said that the verdict is against them.
1. Dr. Noorjehan Sofia Nizaz had filed a petition in High Court through advocates Raju More and Sagar Rane demanding that women should be allowed entry in Haji Ali durgah and go inside till where men are allowed to go. Presently, women are allowed to go only till certain limit in the durgah.

2. High Court has also directed the State Government and Haji Ali Trustee Committee to take care of women’s security.

3. The Court has stated that ban on women from going inside the durgah is against the provisions of Article 14, 15 and 25 of the Constitution.

4. ‘Bhoomata Brigade’s Trupti Desai had earlier staged agitation against ban on women from going to Haji Ali durgah. Now, she has hinted of going to Haji Ali durgah on 28th August; so also to undertake movement against ban on women from going to Shabrimala temple in Kerala.

Court should honour traditions followed even in temples ! – Sanatan Sanstha

Mumbai High Court has passed verdict in Haji Ali durgah issue and shown that it is not biased like the State Government. The State Government provided police protection to Trutpi Desai and helped her in entering temple sanctums and on the other hand, lodged complaint against her when it came to entry in Haji Ali durgah. It is, however, important that the Court does not make such discriminations. Even then, the Court has given stay on its own order and time to petitioners to go to Supreme Court; therefore, why shouldn’t Court be firm on own decision, will be the question asked by everyone.

We are not followers of Islam; therefore, we will not discuss what is allowed in durgah or whether idol-worshipping is allowed in Islam; but when matters relate to temples, it is still our stand that the tradition followed for thousands of years should be respected. As against the number of years such traditions are followed, Court is not older than 50-60 years. Court should respect even temple traditions, was our stand earlier and it is the same even now. Court has no knowledge of Shariat; therefore, such verdict was passed ! – Maulana Sajid Rashidi

The verdict passed by High Court is drawing different responses from Muslims. Maulana Sajid Rashidi has stated in his response given to ANI news agency that whatever happened is not right. It seems that Court has given such decision because it has no knowledge of Shariat.

Hina Zahari, the first lady- Kazi from Uttar Pradesh said, “The decision taken by the Court is good and right. If women can go to sanctum of ‘Kaba’, why is there ban at other places ?”

MIM’s leader Haji Rafat said, “The High Court shouldn’t have taken cognizance of this matter; but since it has passed such order, we will go to Supreme Court.”
