Congress Government claims in the Court that tomb of Afzal Khan was a Holy monument

Mumbai: The Congress-front Government has claimed that the tomb of anti-Hindu Afzal Khan at the base of Pratapgad is a holy monument who was slain by Chhatrapati Shivaji Maharaj, the founder of Hindavi Swarajya (Hindu Empire). Such shocking reference is made in the petition filed by the Government in Mumbai High Court for legalising the unauthorised constructions made by ‘Hazarat Mohammad Afzal Khan Memorial Trust’ around the tomb on Pratapgad. The petition filed without submitting any evidence has been dismissed by Judge J. N. Patel. The above news was published by ‘Dainik Saamna’.

Pratapgad Utsav Committee has filed a petition in Mumbai High Court for demolition of all unauthorised constructions raised around the tomb of Afzal Khan on Pratapgad. The Court took a serious note of the same and ordered the Government to demolish such constructions with time limit upto 30th June 2009 for taking action. In the petition filed by the Government on 22nd September 2009, it has claimed that all the unauthorised constructions were erected before the year 1960. Since the Forestation Act was passed in the year 1980, it cannot be made applicable to these constructions. The tomb of Afzal Khan is a holy monument in Maharashtra and if the unauthorised constructions are demolished, there could be law and order problem in the State. It has been mentioned in the petition that the said constructions should, therefore, be legalised and Govt. Offices should be opened there.

Judge J. N. Patel has rebuked the Government for its petition. During the hearing held on 11th November 2009, few queries were raised by the Judge like was there any proof that constructions by Afzal Khan Memorial Trust by grabbing the land were erected before 1960, whether there was a report by the Forest Officers that such constructions do not fall under the Afforestation Act etc. As Advocate Jyoti Pawar representing the Government stated that there was no proof available, the Judge dismissed the petition. What else can we expect a anti Hindu Congress Govt, which puts question mark on sacredness of Sri Ram Setu or Sri Ram or Sri Ram Janma bhoomi in the Courts.
