New Delhi: In a reprieve for painter M F Husain, the Delhi High Court on Thursday quashed criminal proceedings against the artist for allegedly hurting public sentiments by painting obscene pictures of Hindu goddesses.
"The matter (allegation) is baseless," Justice Sanjay Kishan Kaul said, while granting relief to the 91-year-old painter.
It is a matter of having different perspectives and cannot be the basis for initiating criminal proceedings, Justice Kaul said.
The court quashed the proceedings initiated against Husain on the basis of complaints filed at three different places.
Earlier, it had stayed the proceedings on these complaints.
Husain is living in self-exile in Dubai after a series of protests against the controversial paintings.
The cases filed in different states were earlier clubbed on the direction of the Supreme Court and were being heard by the Additional Chief Metropolitan Magistrate at Patiala House Court in New Delhi.

What a shame! Why not draw pictures of Mother,father,sister & wife of both the judge and MF? Let the pictures be pure (drawing stark nude) - send these to the judge & MF; put them in exibitions in all cities, towns etc. Afterall its a matter of perspective, is it not?
Had the case been about muslim or christi religion - the same judge would not have dared to say anything opposite and shown his (so called)secularity by upholding whatever muslim/christi say

Kerala Pradesh Congress Committe(KPCC) President Ramesh Chennithala and Forest Minister Binoy Viswam (CPI)shared dias with MF Husain recently in Qatar.Normally leaders of political parties avoid sharing dias with controversial figures but these leaders did not care for the feelings of the majority community.

It is not clear what was the approach of petitioners in the Hussain painting case.Obviously it is not easy to press obscenity charges against an artist. Hussain has a huge support from the anglisized secular lobby.This country has had rules-time honoured and time tested rules -on presentation of divinities as sculptures or art form.Any violation of these shastras has been taboo.Unfortunately Hindu shastras are not recognized by the Indian constitution only for condemnation.No one in position has even elementary knowledge of the ethos of the land..Under the circumstances we can only insist that Hussain not name his creations after any Hindu Deity as they are not picturised appropriatly..

The paintings of MF Hussain are not just nude but also overtly sexual and perverted. All the Hindus need to see them & understand the horrible sexual poses they actually depict of our Gods. There are atleast 27 such terrible paintings. Our Hindu actresses like Madhuri Dixit and company dont feel anything wrong in getting their bodies painted by the lecherous 91 year old man. These shameless women always praise MF Hussein.
The end of the Hindu culture & religion is very near and there seems to be no answer in sight. I hate using the term Hindu rashtra as there is not even a Hindu village or a Hindu lane or even a bench on which only a Hindu can sit.
Hinduism may survive only in the West.

I think Justice Sanjay Kishan Kaul has feigned ignorance about the real issue in this case. We Hindus are not against nudity per se. The painter M.F.Husain drew nude caricatures of Hindu Deities in obscene postures and 'named' them as Sita, Hanuman, Saraswati, Durga and so on. We would not have bothered if he had drawn his own islamic religious icons in the nude. He chose to paint them fully clothed and deliberately made obscene caricatures of our revered Deities, which no religious Hindu would tolerate. Whoever was the lawyer from our side, failed miserably! We must approach SC.It is our religious sentiments which were hurt by the perverted painter, and we can never tolerate it.
