Goa : HC to hear MoI case on July 7

Panaji (Goa): The High Court of Bombay at Goa, on Tuesday, has kept decision on interim stay on medium of instruction (MoI) to July 7.

A petition challenging English as MoI was filed by educationist, Mr Pandurang Nadkarni, a resident of Alto-Duler, Mapusa and three minors, Ruhi Dicholkar, represented by her father, Mr Sadanand Dicholkar – resident of Chodan, Arshada Shirodkar, represented by her father, Mr Uday Shirodkar – resident of Taleigao, and by Arkaj Nagvekar, represented by his father, Mr Mahesh Nagvekar – resident of Porvorim before the High Court of Bombay at Goa, on Monday.

In the Court on Tuesday, it was stated by the petitioners’ advocate that the government decision suffers from total application of mind and cabinet has done a headless exercise.

It was also stated that there is the Education Act which has given powers under the statues to directorate of education to decide the medium of instruction and not the council of ministers. Opening of new division for 20 students will be a forced decision for the remaining 15 students in a class of 35 students, it was stated, and it was also said that this should be done in a phased manner, however it has not been done so.

The Court was informed that as per the Central Act, a monitoring committee has to be formed, which was not done, and also the business rules, under Article 166 are violated by the cabinet. The Court has issued notices to the government in this case.

The respondents in this petition are the state of Goa, through its Chief Secretary; the directorate of education; Dr. K B Hedgewar Shikshan Prasarak Mandal, Dr K B Hedgewar Primary School, and Prabodan Education Society’s, Prabodan Prathmik Vidyalay.

The petitioners has prayed to quash and set aside the cabinet decision on providing grants to English medium primary schools dated May 25, 2011 and also to quash and set aside the circular dated June 10, 2011.

The prayer also says, "In the alternate, the Court also issue an appropriate writ, order or direction, restraining the government and the director of Education from implementing the impugned decision, from the academic year 2011-2012."
