Till date The Honorable Supreme court has not delivered the final judgment on the issue of demolishing unauthorized places of worship. The present judgment is merely an interim judgment.
This judgment orders that only those temples that have been built after 7th December 2010 ought to be demolished. In the case of places of worship that have been in existence prior to this date it is suggested that a decision be taken only after a detailed case by case study.

After this judgment, the Karnataka government through its order number H.D. 504 SST (Bha) has conveyed to the honorable Supreme Court that all unauthorized places of worship would be demolished before 31st December 2010. Till date no other state has conveyed anything on these lines to the Honorable Supreme Court. The so-called Pro-Hindu government in Karnataka has taken this action on its own initiative and the honorable Supreme Court has no role in this decision of the Karnataka government. The honorable Supreme Court has given the options of transferring the place of worship to another venue, granting "authorized" status and demolition. However the Karnataka government is hell bent on the single option of demolition. Till date many temples have been demolished in the state, to give a few figures – 34 in Bagalkot, 50 in Chikkaballapur, 42 in Bijapur etc. Many of these have been in existence for hundreds of years and were not posing any kind of inconvenience.

The fact is that if any structure stands on government property for 30 or more years, the owner of the structure automatically becomes the owner of that land.

Many of the places of worship listed in the lists prepared by the government have been at the place where they stand for hundreds of years and are not posing any problem to anyone. When such is the case, it is absolutely wrong on the part of the Karnataka government to say that all unauthorized places of worship will be demolished.  Instead the Karnataka government should study each of the cases individually, case by case and only come to a decision after identifying and studying the type of inconvenience that the structure is causing to the public and traffic movement.
